Bitter is Back [Aug. 21st, 2007|09:47 am]
A day after Bitter threw in the towel, she found a new bitch girl.  She is known as Legal Bitch, and started out blogging about the recent case of Abigail Alliance v. Eschenbach in the DC Circuit. There some good discussion in the comments.  So The Bitch Girls will live on, helped out by legal bitch.

Good thought provoking post.
I think (ie I'm pretty certain) I'm in agreement with your position, but it needs more pondering. I can't yet project/process the other ramifications. Precedent should be subordinate 'right', but there is always a difficulty, always an exception (after all, we ain't perfect yet).

The major obstacle to loosened regulation is that it invites fraud on the part of people making drugs. The whole drug regulatory regime was created out of incidents of people selling rather dangerous formulations, claiming it would heal all manner of ailments, when in reality it did no so such thing, and, if it was particularly bad, probably was poisoning you as well.

Fraud is one of those areas even hard core classical liberals belief government has a public purpose in preventing, so I'm not opposed to the FDA process per se, but it's difficult to balance against the right of people to seek treatment for themselves, and make medical choices, even wrong medical choices.
