On a link from Instapundit yesterday, I read this latest paper on the second amendment. Even if you're not a gun person, but just like to read about history, I would very much recommend it. It gets into the history of gun regulations in colonial times, the militia, impression of arms during the revolution, and the evolution and divergence of American and English common laws as it related to arms. This is one of the first attempts I've seen to address some of the assertions made by the folks at the Joyce funded Second Amendment Research Center, which assert a "Civic Rights" model. This article doesn't really much dispute the idea of a Civic Right, but states that it's been misrepresented or misunderstood by many legal researchers, and can't be understood to negate a general individual right to bear arms recognized within the American body politic.
